1. Acceptance of Terms

By accessing or using the Kapital loan platform, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old, a Kenyan resident, and possess a valid national ID to apply for a loan. For business loans, you must be the registered owner of the vehicle being used as security.

3. Loan Application

All loan applications are subject to review and approval at our sole discretion. Submission of an application does not guarantee approval. A non-refundable processing fee of KSh 150 is payable via M-Pesa upon submission.

4. Accuracy of Information

You warrant that all information you provide is true, accurate, and complete. Providing false or misleading information may result in rejection of your application, termination of any loan agreement, and legal action.

5. Business Loans

For business loans, you agree that the ownership document will be held by Kapital as security until full repayment of the loan. You retain physical possession and use of the vehicle, subject to maintaining comprehensive insurance.

6. Repayment

Loans must be repaid in accordance with the agreed schedule. Late payments will attract penalty charges. Failure to repay may result in collection action, including repossession of secured assets for business loans.

7. Fees and Charges

All fees, interest rates, and charges will be disclosed transparently before loan disbursement. Kapital reserves the right to revise fees with prior notice.

8. Intellectual Property

All content, trademarks, and intellectual property on this platform are owned by Kapital Finance Kenya. You may not reproduce, distribute, or create derivative works without our written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Kapital shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

10. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi.
